Scope

Administrative litigation includes:

  • Opposition opposition procedures
  • Litigation before the Higher Commission for appeal

Opposition and claim procedures

The opposition

Objective: allow any third party to obtain the rejection or limitation of a title request.

Terms:

  • Deadline: 3 months following the publication of the request to the BOPI
  • Condition: justification for payment of the opposition tax
  • Procedure before the opposition committee set up by the Director General

Property claim

Objective: to allow any third party to obtain the transfer to its benefit of a title request.

Terms:

  • Deadline: 3 months following the publication of the request to the BOPI
  • Condition: justification for payment of the corresponding tax

Appeal procedure

Deadline: 60 days from the notification of the contested decision.

Appeal file including:

  • A request for cancellation with complete coordinates of the applicant
  • An ampliative thesis exposing the reasons for the appeal
  • Proof of payment of the appeal tax

Jurisdiction: Higher Commission for the OAPI appeal
