Intellectual property litigation is the set of procedures and mechanisms for resolving disputes relating to intellectual property rights administered by the African Intellectual Property Organization.
L’Oapi litigation exclusively concerns industrial property. It can relate to the allocation of rights, the validity of rights and the violation of rights. The litigation of intellectual property at the OAPI takes place in two separate phases: administrative litigation and legal litigation
Each annex of the Bangui agreement defines:
Matter treated and the extent of conferred rights
Applicable limitations
The violation of conferred rights and sanctions in the event of damage to private rights
All these procedures (administrative and judicial) aim to enforce intellectual property rights for the benefit of all users of the OAPI system, whether national or foreign.
