A plant variety is a plant variety created by humans. The protection system applies to the entire plant kingdom. Wild varieties are excluded. However, if humans improve upon a wild variety, the plant variety can be protected. To be protected, a plant variety must be:
New;
Distinct;
Homogeneous;
Stable;
And to be given a name.
In the area of plant variety certification, there are two types of publication:
The publication of the application and the plant name;
The publication of the plant variety certificate.
This publication allows third parties to file an objection, if necessary, within six months of publication. Plant variety protection lasts for twenty-five years from the date of issue of the plant variety certificate.
