Higher Appeals Commission

Composition

Three full members and three alternate members chosen by lot from a list of judges from the Member States
A President appointed from among the members
Members are appointed for a renewable two-year term

Attributions

Appeals and judicial review body
Examines and rules on appeals against decisions of the Director General concerning:
Refusals to register industrial property titles
Rejections of objections to registration
Rejections of restoration requests
Rejections of applications for extension of protection
Ensures the uniform application of the Bangui Agreement and its annexes

Functioning

It meets in ordinary sessions, usually two to three times a year
Decisions are made by a majority vote, with the President's vote prevailing in the event of a tie
The Commission's decisions are final and not subject to any administrative appeal
Appeals must be lodged within sixty days of notification of the contested decision
